(“TMPG/UNCOVER”, “WE”, “OUR” OR “US”) developed this policy to address its practices as to information collection, use and sharing/dissemination for this Website (for itself as well as in its capacity as a promotion marketing agency in rendering services to its third-party clients (“PRIVACY POLICY”). (As used herein, “Website” includes both [https://tmpg-uncover.com/] and any website that TMPG/UNCOVER develops for a third-party sponsor of a promotional contest/game/sweepstakes/offer.) The Privacy Policy also sets forth your choices with regards to how your personally identifiable information is used as well as how you can access and update your personally identifiable information.

 

BY ACCESSING AND USING THE WEBSITE, YOU AGREE TO THE PRIVACY POLICY.  IF YOU DO NOT AGREE TO THE PRIVACY POLICY, DO NOT ACCESS OR USE THE WEBSITE OR PROVIDE ANY INFORMATION VIA THE WEBSITE.

 

By submitting personally identifiable information (as defined below) via the Website, you agree to TMPG/UNCOVER’s receipt, collection and use of your personally identifiable information in accordance with this Privacy Policy.

  1. TMPG/UNCOVER AS PROMOTIONAL MARKETING AGENCY

 

A.    Third parties who sponsor promotional contests, games, sweepstakes and offers (collectively, “Promotions”) retain TMPG/UNCOVER to function as a promotional marketing agency, administering the Promotion on their behalf. TMPG/UNCOVER is not the sponsor of these Promotions but rather assists in the applicable third-party sponsor in conducting the Promotion. In this context, TMPG/UNCOVER receives, collects and processes participants’ personally identifiable information which is provided on-line via the Website and off-line. By way of illustration, the preceding includes notifying potential prize winners and awarding prizes to verified prize winners.  

 

B.    TMPG/UNCOVER limits access to participants’ personally identifiable information received/collected/processed as part of Promotions sponsored by third parties only to those employees specifically engaged in the administration of the applicable Promotion on a need-to-know basis. Subject to the exceptions of (a) providing participants’ personally identifiable information to the third-party sponsor of the applicable Promotion and (b) complying with applicable law (for example, issuance of an IRS 1099-MISC Tax Form and reporting to the Internal Revenue Service that a given individual has been awarded a prize), TMPG/UNCOVER will not share participants’ personally identifiable information with any outside entities.

 

C.    TMPG/UNCOVER will maintain participants’ personally identifiable information in a secure manner in accordance with prevailing industry standards only for as long as necessary to complete the applicable Promotion (or as requested by the third-party sponsor of same) and as required by applicable law. After such time has elapsed, TMPG/UNCOVER will destroy participants’ personally identifiable information in accordance with prevailing industry standards.

 

D.    Given TMPG/UNCOVER’s role as a promotional marketing agency, TMPG/UNCOVER has no ownership rights of any kind to personally identifiable information provided by participants when participating in Promotions offered by a third-party sponsor. Rather, at all times, participants’ personally identifiable information belongs exclusively to the applicable third-party sponsor (and not to TMPG/UNCOVER), with TMPG/UNCOVER processing the personally identifiable information in compliance with the instructions of the applicable third-party sponsor. TMPG/UNCOVER’s use of personally identifiable information is governed by the applicable third-party sponsor’s Privacy Policy. (The foregoing includes but is not limited to opt-out requests as well as requests to review, correct, update, or delete one’s personally identifiable information. All such requests should be directed to the third-party sponsor of the Promotion in question; but, if received by TMPG/UNCOVER, we will forward the same to the applicable third-party sponsor. In all cases, TMPG/UNCOVER will address such requests in accordance with the third-party sponsor’s instructions in a commercially reasonable manner.) In addition to reviewing this Privacy Policy, participants are strongly encouraged to review the Privacy Policy of the applicable third-party sponsor BEFORE participating in any Promotion offered by such third-party sponsor.

 

E.    To the fullest extent permitted by law, TMPG/UNCOVER disclaims any and all liability under any legal theory with regard to the receipt/collection/use/processing of personally identifiable information for a third-party sponsor once the personally identifiable information is in the third-party sponsor’s possession.

 

  1. INFORMATION COLLECTION

 

 

A.    Third Party Promotions.  Persons who visit this Website (including any website developed by TMPG/UNCOVER for a third-party sponsor) may choose to voluntarily provide the requested personally identifiable information such as their name and contact information (for example, an e-mail address or telephone number). The provided personally identifiable information will only be used to enter the participant in a Promotion, respond to a request for information, to select and contact potential prize winners in the Promotion. TMPG/UNCOVER may also collect sensitive information (for example, date of birth or Social Security Number) when administering a Promotion for a third-party sponsor. TMPG/UNCOVER will not use personally identifiable information or sensitive information so collected for any other purpose.

 

B.    Information Collected by TMPG/UNCOVER for Itself. This Section applies in situations other than third party promotions where TMPG/UNCOVER is functioning as a promotion marketing agency. With regard to TMPG/UNCOVER’s collection of personally identifiable information in situations other than third party promotions,

 

  • TMPG/UNCOVER will only collect personally identifiable information for the specified purpose and will not use the personally identifiable information for any other purposes.
  • TMPG/UNCOVER will only collect personally identifiable information that is relevant and necessary for the purpose for which it is collected.
  • TMPG/UNCOVER will use commercially reasonable efforts to keep such personally identifiable information up to date including honoring participants’ requests to review, correct, update, or delete their personally identifiable information (as discussed below).
  • TMPG/UNCOVER will only retain personally identifiable information only as long as necessary to accomplish the designated purpose in collecting same (subject to compliance with applicable law).

Additional personally identifiable information may also be required (for example, your residential address, telephone number, employment history and academic background) so that we may evaluate your qualifications for the position at TMPG/UNCOVER that you have applied for. In the future, TMPG/UNCOVER may utilize various kinds of marketing communications via the Website; for example, opting in to promotional communications; e-mail newsletters or surveys.  If you are interested, you must provide a valid e-mail address so that we may send you the requested material.  You may opt out of receiving such marketing communications at any time. To do so, simply follow the provided unsubscribe instructions in the applicable e-mail communication.  (Note that even after opting out, you may still receive e-mail communications from us regarding administrative matters.) TMPG/UNCOVER may combine information that you provided via the Website with other information that we have collected on-line and/or offline either from you or about you.   1. INFORMATION COLLECTED FROM YOU PASSIVELY

 

When you use the Website (including by participating in a Promotion offered by a third-party sponsor), TMPG/UNCOVER and/or its third-party service providers may collect non-personally identifiable information even without you directly and affirmatively providing the information to us. 

 

A.    Analytical Information includes the type of browser used to access the Website, the type of operating system you are using, or your ISP (that is, Internet Service Provider) domain name, the website your visited prior to accessing the Website and your activity on the Website/Promotion website. We use analytical information to improve the functionality, structure, content and overall user experience of the Website as well as to gauge the effectiveness of third-party sponsors’ Promotions.

 

B.    Social Media Accounts. We may use applications (also referred to as “widgets”) from third party service providers that allow interaction, integration or content sharing with the corresponding third-party services. These applications may be visible on the Website or may require log-in through the third-party provider’s service. For example, you may be able to enter a given third-party sponsor’s Promotion by using your social media account (such as, Facebook or X [formerly Twitter]). If you choose to do so, you are agreeing to share with us the personally identifiable information included in your social media account profile (for example, your name, gender, date of birth/age, location, e-mail address and “friends.”) This is in addition to the applicable third-party service provider collecting information (directly/affirmatively and/or passively) and perhaps tracking you.  YOU ARE STRONGLY ADVISED TO CAREFULLY REVIEW THE PRIVACY POLICY OF EACH SUCH THIRD- PARTY SERVICE PROVIDER, IN ADDITION TO THIS PRIVACY POLICY.

 

C.    IP Addresses and Related Information.An IP (that is, Internet Protocol) address is a number that is automatically assigned to the computer, laptop or mobile device that you are using by your ISP. When you visit the Website, the IP address is identified and automatically logged into our server log files. In addition to the IP address, the time of the visit to the Website and the page(s) that were visited prior to the visit to the Website are also recorded. TMPG/UNCOVER uses IP addresses to gauge usage of the Website and to maintain and administer the Website (including diagnosing server problems with same).  We may also collect other data pertaining to you and the equipment, software, and communication methods you use to access the Internet and the Website; for example, your ISP, the identification number of your computer and unique identifiers, your media access control address, your operating system, the screen resolution of your computer, the type of browser you use, the pages you access on the Website, the websites you access before and after visiting the Website, the duration of your visit to the Website, date and time stamps, clickstream data, your approximate geographic location, performance statistics, and usage data. TMPG/UNCOVER may use this other data to administer the Website and its servers (including diagnosing server problems with same), to generate statistical information, to monitor and analyze Website traffic and usage patterns, to investigate complaints and violations of our policies, to attempt to prevent fraudulent conduct and, generally, to seek to improve the functionality, structure, content and overall user experience of the Website as well as to gauge the effectiveness of third-party sponsors’ Promotions.  We may combine this information with other collected information (including personally identifiable information provided directly/affirmatively by you) and information obtained from third-party sources for security reasons and to protect the rights of TMPG/UNCOVER, third-party sponsors of Promotions, and perhaps other persons. The suppliers that we use to provide the Website also may collect information about your visits to the Website and other websites.

 

 

D.    Cookies. A cookie is a small text file that is stored on the hard drive of a user’s computer by the browser. Cookies track and record your use of a website. There are two (2) types of cookies: a session ID cookie or a persistent cookie. A session cookie exists only when visiting a website and, once you close or exit your browser, the session cookie expires without any action by you. TMPG/UNCOVER cannot honor “do not track” requests.

 

E.    Other Tracking Technologies. TMPG/UNCOVER may also use one or more of the following tracking technologies which function similarly to cookies. Web Beacons are small graphic data (clear GIFS) with unique identifiers that track user activity and are embedded invisibly on a website.  Pixel Tags are tiny graphics that are loaded onto a website or within an e-mail and tracks the user’s interactions when they visit the website or open the e-mail. Flash Cookies are small data files embedded on a user’s computer/laptop/mobile device which track the user’s online activity. 

 

F.    Embedded Content. The Website may include third party content which collects data regarding the user’s interaction with the content. For example, videos and other visible content, fees and scripts embedded in the code of the Website. YOU ARE THEREFORE STRONGLY ENCOURAGED TO REVIEW THE PRIVACY POLICY OF THE APPLICABLE THIRD- PARTY CONTENT PROVIDER BEFORE INTERACTING WITH SUCH THIRD-PARTY’S CONTENT IN ADDITION TO THIS PRIVACY POLICY.

This Section applies in situations other than third party promotions where TMPG/UNCOVER is functioning as a promotional marketing agency. TMPG/UNCOVER will use and disclose collected information only for the purpose identified at the time of collection of same. For example, if you submit your resume to us via the Website, we will use the information to evaluate your qualifications for the position at TMPG/UNCOVER that you have applied to. In addition, we may use and disclose collected information under the following circumstances:

 

  • To send you important information regarding the Website or our relationship with you, as well as updates to the terms and policies or other administrative information.
  • For our business purposes including review of the effectiveness of the Website, audits, product/service research and development.
  • To third parties that provide services to TMPG/UNCOVER with regard to the Website, including entities that host /moderate the Website; generate and/or review website analytics and other data; and provide IT services. In all cases, the entity in question will only use the collected information so as to provide the applicable services to TMPG/UNCOVER and will NOT use the collected information for its own purposes.

  1. CHILDREN’S PRIVACY

 

The Website is not directed to individuals under the age of 13 and TMPG/UNCOVER (either for its own purposes or in its capacity as a promotional marketing agency for third-party sponsors) does not knowingly collect personally identifiable information from individuals under the age of 13.  If TMPG/UNCOVER discovers that it has inadvertently collected personally identifiable information from individuals under the age of 13, it will be destroyed in accordance with prevailing industry standards.

 

  1. JURISDICTION

 

Persons who live outside the United States (including but not limited to, Australia, Canada, the European Economic Area and the United Kingdom) understand and agree that their personally identifiable information will be transferred to the United States which does not provide as robust protection for one’s personally identifiable information as their home country.  IF YOU LIVE OUTSIDE THE UNITED STATES AND ARE NOT COMFORTABLE WITH THE LEVEL OF PROTECTION ACCORDED TO YOUR PERSONALLY IDENTIFIABLE INFORMATION UNDER UNITED STATES’ LAW,  DO NOT ACCESS OR USE THE WEBSITE OR PROVIDE ANY INFORMATION VIA THE WEBSITE.

We will respond to your request in no more than three (3) business days.  If you have submitted a request, TMPG/UNCOVER will verify your identity. If you are unable to provide the verification information required, or if there is a reason to believe your request is fraudulent, TMPG/UNCOVER may deny your request. The requester will be advised by email regarding the reason a request for an adjustment or correction of personal information was denied and how the requester may appeal the denial.
